1. Acceptance of terms

Loyalink (referred to hereinafter as "Loyalink", "we", "us", or "our") provides informational services relating to credit card offers, cashback, discounts, and merchant promotions across the United Arab Emirates (referred to hereinafter as "Services"). Our Services include, and can be accessed via (i) our website and any other websites bearing the Loyalink branding that are linked to these Terms & Conditions (collectively referred to hereinafter as the "Site") and (ii) any applications for mobile or web devices that bear the Loyalink brand and are linked to these Terms & Conditions (hereinafter referred to as "Application").

Our Services include providing users access to publicly available or partner-provided bank and merchant offers, card product catalogs, nearby deal discovery, and personalized card recommendations based on the card products you select in your portfolio. Use of the Services offered by Loyalink affirms an acceptance to be legally bound by the Terms & Conditions as laid out in this document.

Loyalink reserves the right to alter its Terms & Conditions and to modify or discontinue any aspect, content, or feature of its Services at any time. Using our Services after an alteration has been made constitutes an acceptance of the alterations. Should an arbitrator or court of law conclude that changes applied to these terms would render this contract unenforceable, such changes will only be applicable on a prospective basis.

Commercial and non-commercial exploitation of any portion of our Site, Services, or Application — whether through reproduction, distribution, copying, retransmission, publication, sale, or any other form of transfer — without legal authorization from Loyalink is strictly prohibited.

2. Eligibility

To use Loyalink Services you must be at least 18 years old. By using Loyalink you agree to be bound by these Terms, and warrant that you are at least eighteen (18) years of age and that your registration and your use of our Services is in compliance with any and all applicable laws and regulations in your place of residence.

Loyalink is currently optimized for users in the United Arab Emirates. Access from other jurisdictions is at your own discretion and subject to local laws.

3. End-user terms of use

We offer no warranty with regards to the accuracy, completeness, or continued availability of any offer listed on Loyalink or provided through our Services. We do not guarantee that a bank, merchant, or other third party will acknowledge, honor, or apply offers posted through our Services. Such offers include coupons, discounts, deals, cashback promotions, and sales, for example.

We do not guarantee the accuracy of information, product pricing, eligibility criteria, or discount information. Loyalink will not, in any event, be held liable for a misrepresentation of any offer provided by or on account of a third party. Loyalink will not accept responsibility for any damages relating to or arising from an offer made by a bank, merchant, or other third party.

By using Services provided by Loyalink you state your understanding that Loyalink does not in any way endorse, and is in no way affiliated with, any third-party website that can be accessed via a link on our Services. We accept no responsibility for claims made against linked third-party websites. Terms of agreement for websites linked through Loyalink Services may vary from those offered by Loyalink and should be reviewed by any person considering using those third-party websites or services.

Our Services are not intended to provide credit, mortgage, insurance, or investment advice, and no part of the Services should be construed as an offer to sell, a solicitation of an offer to buy, or a recommendation for any financial product by Loyalink or by any third-party financial services provider or merchant.

Loyalink never requires bank login credentials, full card numbers, CVV codes, or account connections. You select card products you own from our catalog for recommendation purposes only. You remain solely responsible for verifying offer eligibility with the issuing bank or merchant before completing a purchase.

4. Account registration and security

Certain features of the Services require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep that information updated. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

You must notify us promptly if you suspect unauthorized access to your account. Loyalink is not liable for loss or damage arising from your failure to maintain the confidentiality of your account.

5. Ownership and proprietary rights

Loyalink trademarks, trade names, slogans, logos, and service marks displayed through our Services are under the sole proprietorship of Loyalink, and it is expressly forbidden to reuse Loyalink trademarks without express permission from us. All third-party trademarks displayed through our Services — including bank and merchant marks — are the property of their respective owners.

All content available through our Services is the property of either Loyalink, relevant third-party rights holders, or Loyalink licensors. Any form of transmission, publication, modification, removal, destruction, reproduction, or plagiarism of content available through Loyalink Services is strictly prohibited.

By using Services provided by Loyalink you agree that your engagement in such activity, should it cause irreparable damage to Loyalink, its licensors, or third-party rights holders that cannot be remedied by law, may be remedied through injunctive relief. All computer code, text, information, visual interfaces, images, compilation, design, software, product, services, and all other elements that make up the Services are the intellectual property of Loyalink or its licensors and are protected by applicable laws and relevant intellectual property and proprietary rights.

6. Disclaimer

Loyalink Services are provided "as is" and "as available". No warranty, express or implied, is given by Loyalink in regard to the operation and continuity of our Services, except that expressly required by law. By using Services provided by Loyalink, you consent to using our Services at your sole risk. Loyalink disclaims any and all warranties, express or implied, of fitness for any specific purpose.

Loyalink does not guarantee that email or notifications sent from Loyalink are free of destructive or invasive code, and accepts no liability in this regard. Loyalink accepts no liability for any and all damages arising from the use of its Services. We reserve the right to suspend access to our Services at any time, without any liability to you whatsoever.

In using Services provided by Loyalink you accept full responsibility for your interactions and commercial agreements with third-party financial service providers and merchants, and release Loyalink from all liability or claims relating to products and services provided by those parties.

In using Services provided by Loyalink you hereby accept these Terms & Conditions and agree to indemnify Loyalink and its officers, employees, and agents from all claims or demands made by any party as a result of your use of our Services, your violation of these Terms & Conditions, your infringement on the rights of any person or entity through your use of Loyalink Services, or the purchase of products or services by you through our Services.

Loyalink entities will not, in any event, be held liable to you for any consequential, incidental, punitive, or special damages, whether based on statute, warranty, tort (including negligence), contract, or any other legal theory. This limitation will apply whether or not entities have been informed of the possibility of such damages.

If any provision of these Terms is found to be unenforceable for any reason, then that provision will be deemed severable from the Terms & Conditions and shall not affect the validity and enforceability of any remaining provisions. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.

7. Disputes

In accepting these Terms you understand and agree that all rights and obligations and all actions presented in these Terms will be governed by the laws of the United Arab Emirates. Any dispute arising from your use of Loyalink shall be submitted to the competent courts of the United Arab Emirates, and you submit to the jurisdiction and proceedings thereof.

Exception will be made if, to any extent, you have in any manner violated or threatened to violate the intellectual property rights of Loyalink or the intellectual property rights of Loyalink affiliates, partners, or licensors, or otherwise have a cause of action in equity. Should this occur, we may seek injunctive relief in any court of competent jurisdiction and you consent to jurisdiction and venue in any such court for this purpose.

To the fullest extent permitted by applicable law, you agree that disputes relating to these Terms shall be resolved on an individual basis and not as part of a class, consolidated, or representative proceeding.
